{"id":49979,"date":"2023-10-18T10:40:56","date_gmt":"2023-10-18T05:10:56","guid":{"rendered":"https:\/\/presskitaquat.com\/english\/?p=49979"},"modified":"2023-10-18T10:40:56","modified_gmt":"2023-10-18T05:10:56","slug":"its-for-parliament-to-change-law-supreme-court-refuses-to-allow-same-sex-marriage","status":"publish","type":"post","link":"https:\/\/presskitaquat.com\/english\/its-for-parliament-to-change-law-supreme-court-refuses-to-allow-same-sex-marriage\/","title":{"rendered":"It&#8217;s for Parliament to change law: Supreme Court refuses to allow same-sex marriage"},"content":{"rendered":"<p><strong>New Delhi, October 17(Press Ki Taquat)<\/strong><\/p>\n<p>Holding that there\u2019s no fundamental right to marry, the Supreme Court on Tuesday refused to allow same-sex marriages in India even as it directed the Centre to set up a high-powered committee, headed by the Cabinet Secretary, to decide the rights and entitlements of persons in queer unions.<\/p>\n<div id=\"related-stories\">\n<div class=\"col-md-12 news-wrap-block\">\n<div id=\"related-news\">\n<p>A five-judge Constitution Bench led by CJI DY Chandrachud unanimously turned down petitions seeking to allow same-sex marriages under the Special Marriage Act, saying it\u2019s for Parliament to effect changes in the law for validating such unions.<\/p>\n<div id=\"ads-1\">\n<div id=\"v-tribuneindia-v0-0\">\n<div id=\"_vdo_ads_player_ai_5542\" class=\"vdo_video_unit vdo_content\">\n<div id=\"vdo_logo_parent\">\n<p>There were four judgments \u2014 one each pronounced by CJI Chandrachud, Justice Sanjay Kishan Kaul, Justice S Ravindra Bhat and Justice PS Narasimha. Justice Hima Kohli agreed with Justice Bhat. In their verdicts, the judges agreed on certain issues and differed on others.<\/p>\n<p>\u201cThe Constitution does not expressly recognise a fundamental right to marry,\u201d wrote the CJI. Similarly, Justice Bhat ruled: \u201cThere is no unqualified right to marriage except that recognised by a statute, including space left by custom.\u201d<\/p>\n<div id=\"ads-3\" class=\"horizontal-ads\">\n<div id=\"div-gpt-ad-1603703616686-0\" data-google-query-id=\"CJTz0Orp_oEDFX6KZgIdJO0HVw\">\u201cAn entitlement to legal recognition of the right to union, akin to marriage or civil union, or conferring legal status upon the parties to the relationship can be only through enacted law. A sequitur of this is that the court cannot enjoin or direct the creation of such regulatory framework resulting in legal status,\u201d Justice Bhat wrote.Maintaining that gender of a person was not the same as their sexuality, CJI Chandrachud said: \u201cTherefore, since a transgender person could be in a heterosexual relationship, a union between a transman and a transwoman or vice-versa could be registered under the Special Marriage Act and other existing laws.\u201d<\/p>\n<p>With regard to the right of transgender persons in heterosexual relationships to marry as per the existing statutory laws or personal laws, the verdict was unanimous as Justice Kaul, Justice S Ravindra Bhat and Justice PS Narasimha agreed with the CJI\u2019s opinion.<\/p>\n<div id=\"ads-9\" class=\"horizontal-ads\">\n<div id=\"div-gpt-ad-1603704840213-0\" data-google-query-id=\"CJbz0Orp_oEDFX6KZgIdJO0HVw\"><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>New Delhi, October 17(Press Ki Taquat) Holding that there\u2019s no fundamental right to marry, the Supreme Court on Tuesday refused to allow same-sex marriages in India even as it directed the Centre to set up a high-powered committee, headed by the Cabinet Secretary, to decide the rights and entitlements of persons in queer unions.
