New Delhi, August 1 (Press ki taquat bureau): The verdict on the issue of sub-classification for the Socially and Educationally Backward Classes will be delivered by a Seven-judge Constitution Bench headed by CJI DY Chandrachud on Thursday, following the reservation of the decision on February 8.
The arguments presented by Attorney General R Venkataramani, Solicitor General Tushar Mehta, senior advocate Kapil Sibal, and various other senior counsels representing states, focused on the review of the EV Chinnaiah vs State of Andhra Pradesh (2004) verdict, which emphasized the homogeneous nature of all SC communities and the exclusive power of Parliament to exclude castes from the Presidential List under Article 341 of the Constitution.
The Bench, comprising Justice BR Gavai, Justice Vikram Nath, Justice Bela M Trivedi, Justice Pankaj Mithal, Justice Manoj Misra, and Justice SC Mishra, will also address the validity of the Punjab Scheduled Castes and Backward Classes (Reservation in Services) Act, 2006, which introduced 50 percent reservation with a ‘first preference’ for ‘Valmikis’ and ‘Mazhabi Sikhs’ in public employment within the SC quota.
